advanced technologies will be directed against them rather than criminals and terrorists\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element class=\" translation-block\">The emergence of digital surveillance performed by state actors coincides with the rise of authoritarianism and the decline of democracy, the rule of law and civil rights and freedoms. That is why Serbia <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/freedomhouse.org\/country\/serbia\/nations-transit\/2023\" target=\"_blank\" rel=\"noopener\">is considered<\/a><\/span>  a \u201chybrid regime\u201d.<\/p>\n<!-- \/wp:paragraph -->\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4893b2c elementor-widget elementor-widget-text-editor\" data-id=\"4893b2c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">State surveillance reached extremes during the mass anti-government protests in 2019, when the police installed <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/hiljade.kamera.rs\/sr\/pocetna\/\" target=\"_blank\" rel=\"noopener\">1,000 Huawei surveillance cameras<\/a><\/span>  across Belgrade equipped with sophisticated facial and car plate recognition software. The authoritarian model of responding to the pandemic also included <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/ratiuforum.com\/fear-drives-the-states-response-to-covid-19-in-southeast-europe-not-the-import-of-chinese-model\/\" target=\"_blank\" rel=\"noopener\">tracking the movement<\/a><\/span>  of Serbian citizens returning from hotspots like Italy.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5f194e elementor-widget elementor-widget-text-editor\" data-id=\"f5f194e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Meanwhile, Serbian security institutions have procured many digital surveillance tools, including the most intrusive equipment, capable of secretly penetrating and controlling users\u2019 devices and analysing huge amounts of data in detail.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ec4969a elementor-widget elementor-widget-text-editor\" data-id=\"ec4969a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">After the Pegasus scandal became widely known, the Toronto-based Citizen Lab <a href=\"https:\/\/citizenlab.ca\/2020\/12\/running-in-circles-uncovering-the-clients-of-cyberespionage-firm-circles\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #e3b969\">reported<\/span><\/a> that Serbia\u2019s intelligence agency, the BIA, used Israeli NSO Group\u2019s Pegasus spyware and Cytrox\u2019s <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/balkaninsight.com\/2022\/01\/06\/wine-weapons-and-whatsapp-a-skopje-spyware-scandal\/\" target=\"_blank\" rel=\"noopener\">Predator<\/a><\/span>.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8e39c9f elementor-widget elementor-widget-text-editor\" data-id=\"8e39c9f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">The BIA previously used <a href=\"https:\/\/citizenlab.ca\/2015\/10\/mapping-finfishers-continuing-proliferation\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #e3b969\">FinFisher<\/span><\/a> spyware whose server was located inside the public company Telekom Srbija. The notorious Clearview AI should also be added to the list, since investigative reports revealed it was being used by law enforcement.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55ea622 elementor-widget elementor-widget-text-editor\" data-id=\"55ea622\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">The number of actors in Serbia using digital surveillance equipment and software has expanded to state-owned enterprises and government bodies not mandated to provide security, such as the state-owned electric utility power company, <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/birn.rs\/prislusni-centri-unutar-eps-a-nabavili-opremu-kakvu-koriste-tajne-sluzbe\/\" target=\"_blank\" rel=\"noopener\">EPS<\/a><\/span>, and the former Ministry for Trade, Tourism and Telecommunication, MTTT<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b88b392 elementor-widget elementor-widget-text-editor\" data-id=\"b88b392\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">In 2022, the MTTT renewed licences for the Maltego, Mozenda and Social Links software for market inspection purposes. The ministry has previously shown interest in purchasing software from Israeli firm Cognyte, which is mainly <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/about.fb.com\/wp-content\/uploads\/2021\/12\/Threat-Report-on-the-Surveillance-for-Hire-Industry.pdf\" target=\"_blank\" rel=\"noopener\">used<\/a> <\/span> for targeting journalists, regime critics and human right activists.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cc12323 elementor-widget elementor-widget-text-editor\" data-id=\"cc12323\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Although the reasons for the acquisition and use of advanced technologies vary \u2013 from prevention of organized crime, terrorism and sexual abuse of minors on the Internet to the protection of intellectual property and the fight against piracy \u2013 they have one thing in common: there is no legal ground for their introduction and use.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c8a29d elementor-widget elementor-widget-text-editor\" data-id=\"3c8a29d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">Since the government is not inclined to buy intrusive technologies directly from vendors, a number of private security companies based in Serbia, such as IntellSec and Lanus Ltd (now Devellop Ltd), act as intermediaries. Others, like Vlatacom Ltd, design and <a href=\"https:\/\/www.atlanticcouncil.org\/wp-content\/uploads\/2021\/11\/Surveillance-Technology-at-the-Fair.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #e3b969\">sell<\/span><\/a> their own interception\/intrusion software at home and abroad. However, the role of private actors remains unexplored.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-413bc56 elementor-widget elementor-widget-text-editor\" data-id=\"413bc56\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The proliferation of digital surveillance in Serbia is opaque; only reports on individual cases exists. China-style smart cameras (and base stations) spring up after every protest in Serbia. The President and Prime Minister could use <span style=\"color: #e3b969\"><a style=\"color: #e3b969\" href=\"https:\/\/www.vox.com\/2023\/5\/6\/23712805\/serbia-president-vucic-disarmament-mass-shootings\" target=\"_blank\" rel=\"noopener\">recent shootings<\/a><\/span> and social protests against violence to advance problematic laws and policies aimed at control, rather than security.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b18c524 elementor-widget elementor-widget-text-editor\" data-id=\"b18c524\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>The most controversial measure is the Bill aimed at legalizing biometric surveillance in Serbia. The idea of legalizing biometric surveillance to \u201ccounter terrorism and organized crime\u201d was (re)introduced in 2021 after ecological protests and roadblocks against lithium mining \u2013 the Rio Tinto project.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-853f7c7 elementor-widget elementor-widget-text-editor\" data-id=\"853f7c7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">When the Bill, which the Ministry of Interior drafted almost in secrecy, became known to the public, massive dissatisfaction with the introduction of biometric surveillance, <a href=\"https:\/\/bezbednost.org\/en\/draft-law-on-internal-affairs-opens-up-space-for-misuse-of-the-police\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #e3b969\">among other things<\/span><\/a>, forced the Ministry to withdraw the proposal. Aleksandar Vulin, the then Interior Minister, called opponents of the Bill mercenaries of \u201ca few foreign intelligence services\u201d who want to \u201cstage violent rallies with the aim of destabilizing Serbia\u201d.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f776e2 elementor-widget elementor-widget-text-editor\" data-id=\"3f776e2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Soon after the withdrawal of the Bill, information leaked out that the Serbian and the Russian Ministries of Interior had created a \u201cworking group for countering coloured revolutions\u201d [referencing the so-called \u2018orange\u2019 2004 revolution in Ukraine, among others] and that the Serbian police were seeking special training on cybersecurity from Russia \u2013 steps that caused concern among civil society.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d0fcbd elementor-widget elementor-widget-text-editor\" data-id=\"2d0fcbd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>In the present-day political context, the introduction of a mass biometric surveillance system in Serbia remains the greatest threat to privacy and data protection, but it also has a deterrent effect on freedom of assembly and association, as well as freedom of expression.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f6cd87d elementor-widget elementor-widget-text-editor\" data-id=\"f6cd87d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Police authorities deny that smart cameras record people and process biometric data, but the evidence suggests otherwise. In 2019, Neboj\u0161a Stefanovi\u0107, the then Interior Minister, used photos from surveillance cameras to intimidate the protesters and deter them from further rallies. Two years later, thousands of Serbian citizens received court fines for roadblocks during the ecological protests, even though they had not been identified by the traffic police.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4a4c14 elementor-widget elementor-widget-text-editor\" data-id=\"d4a4c14\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>To calm down the situation, the Commissioner for Information of Public Importance and Protection of Personal Data launched an investigation. This concluded that the police had not used facial recognition technology during the rallies, but that persons had been identified \u201cbased on the immediate observation of police officers in line with the Misdemeanour Law\u201d. Unlike people from urban areas, who are more resilient to state oppression, people from smaller communities felt bewildered and frightened, which could impact the number of activists involved in future protests.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-28c6a8a elementor-widget elementor-widget-text-editor\" data-id=\"28c6a8a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Permanent, non-selective, China-style, surveillance is unacceptable in a society that aspires to become democratic and a member of the European Union. This is why civil society in Serbia is united in urging the government to declare a moratorium on the use of mass biometric surveillance technologies and systems.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a98b8e7 elementor-widget elementor-widget-text-editor\" data-id=\"a98b8e7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Public pressure has raised the bar for introduction of advanced technology, but that hasn\u2019t stopped the police from <span style=\"color: #e3b969;\"><a style=\"color: #e3b969;\" href=\"https:\/\/balkaninsight.com\/2022\/04\/12\/serbia-targets-purchase-of-powerful-swedish-facial-recognition-software\/\" target=\"_blank\" rel=\"noopener\">acquiring<\/a> <\/span>Swedish Griffeye face recognition software and restarting public consultations to fine-tune the new Internal Affairs Act.
