But the <span style=\"color: #e3b969;\"><a style=\"color: #e3b969;\" href=\"https:\/\/www.panoptikon.si\/wp-content\/uploads\/2024\/02\/01022024_sodba_mol.pdf\" target=\"_blank\" rel=\"noopener\">ruling of an administrative court<\/a><\/span> made it clear that making the CCTV system data available is in the public\u2019s interest, not just because the system was paid for with public funds but also because the citizen have the right to know where and how the municipality is surveilling them. \u00a0<\/p>\n<!-- \/wp:paragraph -->\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e58564 elementor-widget elementor-widget-text-editor\" data-id=\"4e58564\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>During the hearings of this case, the municipally-owned company used several bad faith arguments to block the release of the data under the local FOIA law. First, they tried to shift the responsibility to the municipality, which previously named the company as the relevant actor. The company then claimed that the data set is too big to compile. Other ineffectual arguments used were: the release of the data will have negative consequences for crime prevention and that the data was not in the public interest.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9b8cbd elementor-widget elementor-widget-spacer\" data-id=\"f9b8cbd\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ee8ba82 elementor-widget elementor-widget-heading\" data-id=\"ee8ba82\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">WHAT IS THE FUNCTION OF THE MUNICIPAL CCTV SYSTEM IN SLOVENIA?<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aefbf9e elementor-widget elementor-widget-spacer\" data-id=\"aefbf9e\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f407150 elementor-widget elementor-widget-text-editor\" data-id=\"f407150\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><a href=\"https:\/\/www.drzavljand.si\/en\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #e3b969;\">Dr\u017eavljan D\/Citizen D<\/span><\/a> set up project '<span style=\"color: #e3b969;\"><a style=\"color: #e3b969;\" href=\"https:\/\/www.panoptikon.si\/\" target=\"_blank\" rel=\"noopener\">Panoptikon<\/a><\/span>\u2019 in order to asses and question <span style=\"color: #ead181;\">the functionality of municipal CCTV systems<\/span> throughout Slovenia. By sending out FOIA requests to the municipalities, they have collected data from over 20 largest municipalities in Slovenia in their database. Most municipalities were willing to provide the data.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0330df8 elementor-widget elementor-widget-text-editor\" data-id=\"0330df8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Some of them were publishing the data themselves, quoting the General Data Protection Regulation (GDPR) and data protection impact assessment. The data shows that most of the municipalities were using the cameras for traffic control, protection of municipal property and artifacts (train\/bus stations, squares, parks).<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0a9e568 elementor-widget elementor-widget-text-editor\" data-id=\"0a9e568\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Data on Ljublana\u2019s CCTV system revealed that the Slovenian capital boasts a significantly larger number of CCTV cameras than the other nine largest municipalities (536 cameras in Ljubljana, 384 cameras total in others).<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-373637d elementor-widget elementor-widget-text-editor\" data-id=\"373637d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>But <span style=\"color: #ead181;\">how effective are these CCTV systems<\/span>? Most of the observed municipal cameras in Ljubljana are low-budget Dahua CCTV cameras. While the municipality does not publish any statistics in this regard, we were able to find several reports of criminal activities where the cameras explicitly did not assist the police in the prevention of crime.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-951ce7f elementor-widget elementor-widget-text-editor\" data-id=\"951ce7f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>For example, the central marketplace in Ljubljana currently has 40 cameras in place, which were installed in October 2022, to \u2018prevent crime\u2019. When asked about the crime statistics, the municipality responded they do not keep records, but based on individual crime reports, the new years\u2019 celebration in 2023 was the worst in terms of crimes-committed in the last five years. The cameras were not at all useful in this regard.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7eea293 elementor-widget elementor-widget-text-editor\" data-id=\"7eea293\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Another case where the CCTV proved its ineffectiveness was the months-long theft of copper-elements in outdoor lightning in Tivoli, the biggest park in Ljubljana park. Even though the cameras recorded the perpetrator on different occasions, the police went on record saying that the recordings were useless as their image quality was very low.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-21a0923 elementor-widget elementor-widget-text-editor\" data-id=\"21a0923\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p class=\" translation-block\">This would mean that the only thing that the municipal CCTV system is good for in these public areas is for <span style=\"color: #ead181\"> spying on innocent citizens<\/span> walking through the park or the marketplace in broad daylight, without criminal intent.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a21ac91 elementor-widget elementor-widget-spacer\" data-id=\"a21ac91\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c36219 elementor-widget elementor-widget-heading\" data-id=\"8c36219\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">CHANGING THE STATUS-QUO OF HOW CCTV SYSTEMS ARE USED<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f7fddf9 elementor-widget elementor-widget-spacer\" data-id=\"f7fddf9\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c165eb2 elementor-widget elementor-widget-text-editor\" data-id=\"c165eb2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"color: #ead181;\">Data transparency<\/span> on the municipal CCTV systems is just the first step in starting a debate and changing the decision-making process regarding the procurement and usage of these technologies.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b027062 elementor-widget elementor-widget-text-editor\" data-id=\"b027062\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Dr\u017eavljan D\u2019s case clearly shows that mapping projects by independent actors are not an effective solution, but they do shine an initial light on the issue. The arguments in the court case against the CCTV company will serve as an effective tool in countering any future FOIA rejections by other municipalities in Slovenia, and possibly across the EU.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7c3eb65 elementor-widget elementor-widget-text-editor\" data-id=\"7c3eb65\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Another issue to address in the debate about the use of this technology is access to data that shows whether or not these cameras are effective. Dr\u017eavljan D have already sent a new FOIA request to the municipality, requesting the crime reports that are based on CCTV data. They will further call on the municipalities to provide clear numbers on CCTV effectiveness in crime prevention\/determent, urban planning and other claimed CCTV functions.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b9e9fed elementor-widget elementor-widget-text-editor\" data-id=\"b9e9fed\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>There needs to be an <span style=\"color: #ead181;\">informed debate<\/span> on this topic and that cannot do that if the bulk of the municipality\u2019s reasoning is wrapped up in hearsay and opaque decisions are taken by a municipally-owned company that tries really hard to behave like a private actor.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9eaf59e elementor-widget elementor-widget-text-editor\" data-id=\"9eaf59e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>There is also a question of the <span style=\"color: #ead181;\">role of informed citizens<\/span>. Municipal CCTV cameras in Ljubljana sometimes appear without any clear labels, which is a violation of law. Dr\u017eavljan D have reported a few instances to the national DPA that is currently opening an investigation into the matter. At the same time, the majority of the people simply does not care about public surveillance, because the system is relatively opaque and there is a lack of public discussion. Interestingly, Dr\u017eavljan D are the first to map the municipal CCTV cameras via FOIA requests \u2013 in the past, journalists and other actors were mostly relying on official statements and unofficial numbers when writing about this issue.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fdd57c6 elementor-widget elementor-widget-text-editor\" data-id=\"fdd57c6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Finally \u2013 after the data and effect reporting takes place, there needs to be an honest discussion and a clear decision-making process that will answer the question: Is the municipal CCTV system a force for good or are we all just paying prime seats in the first row of the security theater?<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e76798c elementor-widget elementor-widget-spacer\" data-id=\"e76798c\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6a41422 elementor-widget elementor-widget-heading\" data-id=\"6a41422\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">WHAT NEXT?<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1247919 elementor-widget elementor-widget-spacer\" data-id=\"1247919\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e1dd3e1 elementor-widget elementor-widget-text-editor\" data-id=\"e1dd3e1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Dr\u017eavljan D\u2019s ultimate goal is to <span style=\"color: #ead181;\">improve the data management and CCTV cameras scheme<\/span> by proposing new legal frameworks that regulate this topic.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2052b3 elementor-widget elementor-widget-text-editor\" data-id=\"f2052b3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>After the wrap-up of the CCTV cameras mapping phase, they aim to expand their investigation by focusing on the CCTV data management by issuing new personal data requests. They will further investigate the quality of the CCTV recordings and how the city managing this data.
