The following analysis aims to inform the upcoming reform processes in the area of personal data protection, primarily so that the future legal framework provides citizens with better protection of rights, gives handlers and the supervisory authority more precise frameworks for action, and generally improves the legal security in the country. The analysis provides an overview of the basic differences between the two data protection regimes, as well as the level of compliance of the Personal Data Protection Act with the Law Enforcement Directive (LED). Also, in order to gain insight into the various modalities of transposition of the LED into Serbian national legislation, the analysis presents some examples of the practice of individual EU member states in the field of LED’s application.
